Showalter Quoted on EPA’s Shift to Prioritize Compliance Over Enforcement

Partner J. Michael Showalter was quoted on how the Environmental Protection Agency’s (EPA) new “compliance first” doctrine may not mean less agency enforcement, despite concerns from environmental advocates.

Mike said that the EPA’s Office of Enforcement and Compliance Assurance has always emphasized compliance and tried to work with regulated entities.

He added that the memo “only says compliance first. It doesn’t say enforcement never.”

However, Mike said that the new guidance does hint at reduced enforcement when seen in the context of other changes made by the current EPA administrator, citing that the agency has proposed eliminating greenhouse gas reporting requirements, prioritized fossil fuel development, and reduced its workforce, Mike said.
