Marsh Quoted on Schedule A Pause and Risk to Counterfeit Litigation

Partner Michelle Mancino Marsh was quoted on a Northern District of Illinois decision denying a temporary restraining order and potentially pausing Schedule A litigation in that District to reassess its use, a move that Michelle said could complicate anti-counterfeiting efforts.
Schedule A is a legal mechanism that allows brand owners to file suit against alleged counterfeiters with minimal procedural hurdles.
“There typically isn’t a defendant who is willing to show up” to court, Michelle said, adding that “you’re putting up additional barriers for brand owners, and that can have serious implications” for them in the fight against counterfeits.
